These Terms & Conditions govern your use of the BetaBoxTS website and, unless superseded by a signed service agreement, your engagement with our services. By accessing this site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the site.
BetaBoxTS provides managed IT services, web and application development, managed hosting through our HostPhenix brand, and CMMC / NIST 800-171 compliance advisory services. Specific deliverables, timelines, fees, and service levels are defined in individual proposals, statements of work, or service agreements, which control in the event of any conflict with these Terms.
You agree to use this website only for lawful purposes. You may not attempt to gain unauthorized access to any portion of the site, interfere with its operation, scrape or harvest data, or use the site to transmit malicious code. Information submitted through our forms must be accurate and submitted by you or with proper authorization.
All content on this site, including text, graphics, logos, and code, is the property of BetaBoxTS or its licensors and is protected by copyright and trademark law. HostPhenix is a brand of BetaBoxTS. You may not reproduce, distribute, or create derivative works from site content without our prior written permission. Ownership of work product created under client engagements is governed by the applicable service agreement.
Professional services are provided under separate written agreements that define scope, fees, confidentiality, and responsibilities. Estimates and assessments provided through this site or in initial consultations are informational and do not constitute a binding commitment until a written agreement is executed.
Use of our managed hosting services is additionally subject to our Acceptable Use Policy and our DMCA Policy. We may suspend or terminate hosting services that violate those policies as described therein.
Fees for services are set out in the applicable agreement or invoice. Unless otherwise stated, invoices are due upon the terms specified on the invoice, and late or unpaid balances may result in suspension of services after reasonable notice. You are responsible for applicable taxes other than taxes on our income.
Our CMMC and NIST 800-171 services are technical and advisory in nature. We help organizations implement and document security controls, but we do not provide legal advice, and no service we perform guarantees certification, assessment outcomes, or regulatory approval by any third party or government body.
This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.
To the maximum extent permitted by law, BetaBoxTS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website. Liability arising from paid services is limited as set forth in the applicable service agreement.
You agree to indemnify and hold harmless BetaBoxTS and its officers, employees, and agents from claims, damages, and expenses arising out of your misuse of the site or your violation of these Terms.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, and any disputes shall be resolved in the state or federal courts serving Montgomery County, Tennessee. We may update these Terms from time to time; the date above reflects the latest revision, and continued use of the site constitutes acceptance of the updated Terms.
